A trademark is the distinctive design, graphics, logo, symbol, words, or any combination thereof that uniquely identifies a firm, brand, and/or its goods or services which guarantees the item’s genuineness, and gives the owner the legal rights to prevent the trademark’s unauthorized use. Simply to provide protection and to prevent others from using certain traits. 

When trademarking, there are a few questions to ask:

– Type of business  – e.g. online retail fashion for ladies

– Trademark category  – e.g. brand name, design or invention

– Country of trademark – e.g. Hong Kong, China, US, UK, Italy, Japan….

– Content for trademark – e.g. branding on company name ( words) branding on company logo (graphics) 

– sub category – e.g. printing hardcopies, online softcopies logo/ brand name, garment – material, ladies wear, cotton, wool….

Prices are based on the country and all sub categories of trademark and HK trademark is valid for 10 year and can be renewed indefinitely.

Application process is around 8 to 12 months. But the trademark is active on the day you file your papers for trademarking. So in the unlikely even that you go to court over a trademarking case, whoever filed the original trademark first is the rightful owner.
